Da Vinci Robot Lawsuits
According to a recent report from Bloomberg.com, the da Vinci Surgical System has become an increasingly popular alternative for patients undergoing prostatectomies, hysterectomies and other minimally invasive procedures. However, some critics have charged that the growth of robot surgery is the result of aggressive marketing that touts the supposed advantages of robotic surgery without much scientific evidence to back up such claims.*
Over the past year, questions about the safety and efficacy of robotic surgery have continued to mount. According to Bloomberg, at least 50 da Vinci robot lawsuits have been filed by individuals who allegedly suffered serious, and in some cases fatal injuries allegedly due to the device. At the same time, the article noted that reports of robotic surgery complications to the U.S. Food & Drug Administration (FDA), some of which involved patient injuries, more than doubled over the past year.*
In September, another Bloomberg.com report detailed findings published in Obstetrics & Gynecology that showed no advantages over robotic hysterectomy compared to other minimally invasive alternatives. The same study also found that robotic procedures may even double a woman’s risk of developing post-operative pneumonia.**
In August, a study published in the Journal of Healthcare Quality suggested that da Vinci complications may be underreported to the U.S. Food & Drug Administration (FDA).*** In February, a study published in the Journal of the American Medical Association reported that the costs associated with robotic surgery hysterectomy was more expensive compared to other methods, with little difference in complication rates.****
Most recently, an FDA survey involving a small group of doctors who use the da Vinci that was released on November 8th revealed that training on the device is an issue that may impact patient safety. Some of the doctors surveyed by the agency also reported observing a number of da Vinci complications, including reversible limb palsy, temporary nerve damage in the fingers, seromas in obese patients, bleeding from perforated bowels, urethral stricture/stenosis, and peripheral vision loss.
