New York, NY (PRWEB) April 30, 2013
As da Vinci robot lawsuits continue to mount in courts throughout the country, Bernstein Liebhard LLP notes that a prominent surgeon has called for the development of national training standards for robotic surgery. According to an article appearing in the Wall Street Journal on April 29, 2013, Dr. David B. Samadi, Chief of Robotics and Minimally Invasive Surgery at The Mount Sinai Medical Center, recently appeared on Fox News 5 to discuss robotic surgery, and pointed out that the learning curve for these procedures “cannot be overlooked.” Dr. Samadi went on to express his hope that renewed scrutiny from the U.S. Food & Drug Administration (FDA) “can lead us to enforced national standards for robotic surgeon training and specific procedure experience.”*
“Dr. Samadi’s call for national robotic surgery training standards highlights the problem of adequate training as it relates to the growing use of the da Vinci robot. While Intuitive Surgical denies any suggestion that they engaged in inadequate surgeon training and improper certification, training is at issue in many da Vinci robotic surgery lawsuits. We agree with Dr. Samadi that doctor training is an important issue that needs immediate attention,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm is currently offering free legal evaluations to individuals who allegedly suffered serious da Vinci surgery complications in minimally-invasive procedures involving the da Vinci Surgical System.
Da Vinci Robotic Surgery Lawsuits
The da Vinci Surgical System has been on the market since 2000, and is used in a wide range of minimally-invasive surgeries, including hysterectomies, gall bladder removal, prostate removal, heart surgeries, and thyroid procedures. According to a recent report from Bloomberg.com on March 1, 2013, the FDA has launched a survey of doctors to determine if an increase in reports of da Vinci surgery complications could be the result of a problem with the technology. The da Vinci robot has been associated with 70 deaths in informal incident reports sent to the agency since 2009. Reports to the FDA of possible da Vinci surgery complications have also increased, jumping to at least 115 in 2012 from 24 in 2009, Bloomberg said.**
In a recent filing with the U.S. Securities and Exchange Commission on March 31, 2013, Intuitive Surgical acknowledge that it had been named in 26 da Vinci robot lawsuits filed on behalf of patients who allegedly suffered serious complications in robotic surgery procedures. Among other things, Plaintiffs claim these injuries were the result of defects in the da Vinci Surgical System and/or the company’s failure to provide adequate training resources to healthcare professionals.***
According to court records, the nation’s first trial involving a da Vinci robotic surgery lawsuit began earlier this month in Washington state court. (Estate of Fred E. Taylor v. Intuitive Surgical Inc., 09-2-03136-5, Superior Court, State of Washington, Kitsap County) According to a notice entered in the U.S. District Court, Eastern District of Louisiana on March 14th, the company has already agreed to settle one da Vinci robot lawsuit filed by a woman who allegedly suffered serious complications during a thyroid procedure. (Silvestrini v. Intuitive Surgical Systems Inc., No. 11-2704 (E.D. La.)
