$40 Million Class-Action Skechers Lawsuit Settlement Approved by Federal Judge, Reports Wright & Schulte LLC

Federal Judge Thomas B. Russell of Louisville has just approved a deal that will grant a $40 million settlement to hundreds of thousands of consumers in a class-action Skechers lawsuit that consolidated more than 70 Skechers lawsuits throughout the U.S. Consumers involved in this case are eligible to receive a full refund for the purchase of their Shape-Ups (up to $80), their Resistance Runner shoes (up to $84), their Podded Sole shoes (up to $54) and their Tone-Ups (up to $40) as part of this Skechers lawsuit settlement.

While the two primary plaintiffs in this case will each be awarded $2,500, the attorneys representing the consumers have been awarded a total of $5 million to split, which will not come out of the $40 million awarded to consumers. The judge also ordered that any money remaining after all consumers in this Skechers lawsuit have been compensated will go to the FTC. The judge’s approval of the $40 million settlement in this class-action Skechers lawsuit has been handed down just about one year after Skechers and the plaintiffs had initially agreed upon it.

Although Skechers has denied allegations that it falsely advertised the health benefits of its toning shoes, representatives for the company have stated that Skechers ultimately decided to settle to preclude the possibility of having to a endure long, expensive trial in this class action Skechers lawsuit. Alleged Deceptive Advertising Regarding Skechers Toning Shoe Benefits
At the heart of this recently settled class-action Skechers lawsuit was the alleged claim that Skechers intentionally misled consumers in advertising for its toning shoes by claiming that these shoes provided health benefits that had not been substantiated by scientific evidence. While television ads used star power to claim that Skechers toning shoes could help users lose weight without going to the gym, other marketing materials for the Skechers toning shoes claimed that they could improve posture, strengthen the back, firm and tone leg and buttocks muscles, improve circulation, tighten abdominal muscles, and reduce knee joint stress.

However, an independent study conducted by the American Council on Exercise (ACE) and first published in June 2010 found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [ June 2010]

The approval comes a year after Manhattan Beach, Calif.-based Skechers reached a deal with the Federal Trade Commission over the ads. The settlement covers more than 70 lawsuits from across the country. The lawsuits were consolidated in federal court in Louisville. Skechers denied the allegations but said it settled to avoid long litigation.
