$4 Billion DePuy ASR Hip Recall Lawsuit Settlement Reportedly Agreed to by Johnson & Johnson Reports Wright & Schulte LLC
Date:11/14/2013

Columbus, Ohio (PRWEB) November 14, 2013

Johnson & Johnson could be gearing up to settle thousands of DePuy ASR Hip Recall Lawsuits filed since it announced a worldwide DePuy ASR hip recall in August 2012. According to a report published by Bloomberg News that is based on several anonymous sources, the company has agreed to a $4 billion DePuy ASR Hip Recall Lawsuit settlement. If the DePuy ASR Hip Recall Lawsuit settlement comes to fruition, it would be the largest medical device settlement in history. [bloomberg.com/news/2013-11-12/j-j-said-to-reach-4-billion-deal-to-settle-hip-lawsuits.html, Bloomberg News, November 12, 2013]

The DePuy ASR hip recall lawyers at Wright & Schulte LLC are already representing clients in DePuy ASR lawsuits, and are extremely pleased with this development. Among other things, compensation for individual DePuy ASR Hip Recall Lawsuit plaintiffs would average around $300,000 per case, according to Bloomberg. What’s more, the reported agreement would not preclude DePuy ASR hip recipients who have yet to file DePuy ASR Hip Recall Lawsuits from seeking compensation for complications suffered in the future. The DePuy ASR Hip settlement agreement is expected to be announced sometime next week in U.S. District Court, Northern District of Ohio, where thousands of DePuy ASR hip recall claims have been consolidated for pretrial proceedings. The DePuy ASR hip replacement recall was announced after it became apparent that the metal-on-metal hip implant was associated with a high rate of early failure. According to court documents, DePuy ASR Hip Recall Lawsuit filed since the recall allege that the device was defectively designed, and that patients and the medical community weren’t adequately warned of its risks. DePuy ASR Hip Recall Lawsuit Plaintiffs further allege that metal particles released due to wear of the hip’s metal components can cause metallosis, pain, swelling, chromium and cobalt poisoning, and other serious complications.

According to Bloomberg News, the proposed DePuy ASR Hip Recall Lawsuit settlement would resolve about 7,500 of 12,000 claims pending against Johnson & Johnson and its DePuy Orthopaedics unit. Remaining DePuy ASR Hip Recall Lawsuit claims, which were filed by people who are worried they may suffer complications that could lead to revision surgery in the future, will be subject to a second round of settlements.

According to court records, the nation’s first DePuy ASR hip recall trial ended in March in California, as the plaintiff prevailed and was awarded more than $8 million. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, the companies scored a victory in a second trial that concluded a month later. (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County, Illinois). The first trial in the federal litigation underway in Ohio was supposed to begin in September, but was postponed. (McCracken v. DePuy, 11-dp-20485, U.S. District Court, Northern District of Ohio (Toledo))
