$2.5 Billion Settlement In DePuy ASR Hip Replacement Lawsuits, Reports Wright & Schulte LLC

The DePuy ASR hip lawsuit settlement lawyers at Wright & Schulte LLC applaud a $2.5 Billion Settlement in DePuy ASR Hip Replacement Lawsuits. The announcement today in Ohio Federal Court could lead to the settlement of some 8,000 DePuy ASR hip lawsuits. These lawsuits were filed on behalf of individuals who underwent revision surgeries due to complications allegedly associated with a recalled ASR metal-on-metal hip. According to court documents, if the settlement proposal is approved, each of these DePuy ASR recall plaintiffs would receive part of the $2.5 billion settlement (one maximum Base Award of $250,000 that is subject to potential reductions ) for each revision surgery they required. The settlement would also provide a supplemental award to pay for “extraordinary injuries”, such as heart and kidney problems, that DePuy ASR hip replacement lawsuits allege were the result of exposure to toxic metal particles shed from the devices. Wright & Schulte LLC is representing numerous plaintiffs in DePuy ASR hip implant lawsuits whose cases have been filed in the proceeding underway in U.S. District Court, Northern District of Ohio. According to court documents, all of the lawsuits filed in that litigation were brought on behalf of individuals who suffered metallosis, pain, swelling, chromium and cobalt poisoning, and other serious complications allegedly associated with ASR hip implants, which were voluntarily recalled in August 2010 due to an unacceptably high failure rate. The lawsuits further allege the metal-on-metal hip replacements were defectively designed, and that patients and the medical community weren’t adequately warned of their risks.

According to court records, the proposed DePuy ASR hip lawsuit settlement announced today would resolve a portion of some 12,000 product liability claims filed since the DePuy ASR hip recall was issued. Remaining claims, which were filed by people who are worried they may suffer complications that could lead to revision surgery in the future, will be subject to a second round of settlements.

The U.S. DePuy ASR Hip Settlement Program is available for U.S. ASR patients who had revision surgery for reasons related to the recall as of August 31, 2013 and must meet the following requirements

  •      Must be a United States citizen or a legal resident of the United States;
  •     Had undergone surgery to implant an ASR™ XL Acetabular Hip System or ASR™ Hip Resurfacing System (“ASR”) in a United States hospital or at a U.S. Military Hospital;
  •     Must have had the ASR in place for at least 180 days; and
  •     Had undergone revision surgery to remove the ASR for reasons related to the recall on or before August 31, 2013.
