bj-diagnostik GmbH: The German Genetic Diagnosis Act will Become Effective 01.02.2010 - What Will Change for Paternity Testing?
Date:1/26/2010

bj-diagnostik GmbH, one of the first private companies providing paternity and other ancestry testing in Germany, summarizes the most important legal issues against the background of the new German Genetic Diagnosis Act ("Gendiagnostikgesetz"): German legislation has passed several bills since 2008 to regulate contestation or determination of biological paternity as well as paternity testing. The new Genetic Diagnosis Act, which will become effective February 2010 and mainly regulates clinical genetic diagnosis, will also modify the conditions under which private DNA paternity tests can be performed.

The new Human Genetic Examination Act (in short: Genetic Diagnosis Act or GenDG), though, will now make a simple, private DNA paternity test more complicated (in German the buzz word is Vaterschaftstest).

From a scientific perspective, it is hardly justifiable to include DNA paternity testing in a bill to regulate genetic clinical diagnosis, since DNA paternity tests do not examine genes that carry genetic information about human characteristics or illnesses, but only those parts of the DNA that do not encode genetic information, except the gender of the person tested. These tests only det
