Valencell Files Patent Infringement Suit against Apple, Inc. and Fitbit, Inc.
Date:1/4/2016

RALEIGH, N.C., Jan. 4, 2016 /PRNewswire/ -- Valencell, the leading innovator in wearable biometric data sensor technology, today filed patent infringement lawsuits in the United States District Court for the Eastern District of North Carolina against both Apple, Inc. and Fitbit, Inc. Valencell asserts Apple, Inc.'s and Fitbit, Inc.'s products infringe on Valencell's intellectual property, including United States Patent numbers:

  • 8,923,941 - Methods and apparatus for generating data output containing physiological and motion-related information
  • 8,886,269 - Wearable light-guiding bands for physiological monitoring
  • 8,929,965 - Light-guiding devices and monitoring devices incorporating same
  • 8,989,830 - Wearable light-guiding devices for physiological monitoring

"Since 2006, Valencell recognized that it would take a focused, multidisciplinary team to develop and validate accurate biometric sensor technology that would ultimately fuel compelling use cases in the wearables market. Rather than manufacture its own wearables, Valencell has repeatedly chosen to partner with existing consumer electronics companies and manufacturers while continuing to focus our R&D on creating the future in biometric wearables," said Dr. Steven LeBoeuf, President of Valencell. "As more and more wearable products powered by Valencell's award-winning PerformTek® sensor technology are now available in the marketplace, and the market has begun to value the importance of highly accurate biometric wearables, we've seen some companies choose to use our patented inventions without pursing a patent license. We will defend our intellectual property to ensure our current and future licensees get the full value of licensing our inventions, as we continue to innovate around our foundational dream of seamless, personalized mobile health and fitness."

Valencell's patent portfolio includes 29 granted patents, with more than 60 patents pending, and is the most highly-cited patent portfolio in wearable biometrics. In 2015, Valencell saw a record year of growth with its PerformTek biometric sensor technology, with a 133 percent increase in licensees over 2014. With over 25 total licensees, Valencell continues to see global demand for highly accurate biometric sensor technology with significant growth in ear and wrist wearables. About Valencell
Valencell develops performance biometric sensor technology and licenses this patent-protected technology to consumer electronics manufacturers, mobile device and accessory makers, sports and fitness brands and gaming companies for integration into their products. Valencell's PerformTek® biometric sensor technology employs biophysical signal characterization to actively characterize biophysical signals for removing physical noise and extracting highly accurate biometric information. Valencell's PerformTek-powered sensors are the most accurate wearable biometric sensors that continuously measure heart rate and activity. Valencell has invested years into the research and development of its PerformTek sensor technology, protected by dozens of granted patents and independently validated by the Duke Center for Living, North Carolina State University, the Human Performance Laboratory and a fellow of the American College of Sports Medicine.
