Caso Zeltiq - CLINIPRO: El juzgado da la razón a CLINIPRO - LipoCryo

CLINIPRO, empresa española fabricante de aparatología médico-estética, anuncia que el Juzgado de lo Mercantil no. 5 de Barcelona ha dictado Sentencia, de fecha 25 de enero de 2013, desestimando íntegramente la demanda interpuesta por Zeltiq Aesthetics Inc. (Nasdaq: ZLTQ) y Hospital General de Massachusetts (MGH) contra CLINIPRO, por presunta infracción de patentes y actos de competencia desleal. El asunto ha sido defendido por el despacho SOL MUNTAÑOLA & ASOCIADOS a quien CLINIPRO encargo la dirección letrada.

La sentencia razona que las patentes de las actoras son nulas, por falta de actividad inventiva (la patente de procedimiento) y por falta de novedad (la patente de dispositivo), por lo que desestima la demanda interpuesta. Del mismo modo, la sentencia rechaza la existencia de actos de competencia desleal, también objeto de la demanda, entre otros motivos, porque Zeltiq y MGH no pueden apropiarse del nombre que describe la técnica de aplicación de frío para reducir grasa (cryolipolysis). La sentencia impone a Zeltiq y MGH el pago de las costas ocasionadas, aunque CLINIPRO está estudiando la posibilidad de solicitar, además, los daños y perjuicios ocasionados.

Recordamos que, debido a la demanda interpuesta por MGH y Zeltiq contra CLINIPRO por violación de sus patentes, se dictó un primer Auto, de 5 de mayo de 2012, en el que se acordaron unas medidas cautelares contra la comercialización de LipoCryo en España. Posteriormente, dichas medidas quedarían sin efecto mediante Auto del 25 de junio de 2012, aceptando el Juzgado la prestación de una caución sustitutoria.
